Government Asking Unaccompanied Children to Sign Rights-Waiving Forms
Government agencies are reportedly asking unaccompanied immigrant children to sign a form declaration that waives various fundamental rights and legal protections—and could even expose them to future criminal prosecution—as a condition of accepting voluntary departure from the United States. Two versions of this document are in circulation, one labeled “Addendum to Form I-210—Alien Declaration.” The American Immigration Lawyers Association (AILA) has transcribed both versions verbatim and warns that important differences exist between them, potentially leading to serious legal consequences for the children who sign. At this time, it remains unclear how widely the forms are being used or whether DHS and ORR are employing one or both versions. The agencies have not confirmed their scope or intent.
